They accuse you of date rape, did someone else spike their drink?

You thought you got lucky, but nothing could be further from the truth. The girl you hooked up with at an off-campus party is now accusing you of date rape. You could not have had a more unlucky start to the semester if you tried. 

You remember it clearly; yes, you had had a bit to drink, but so had she. When she came over and grabbed you to dance, it took you by surprise, but hey, why not. It was not even your idea to go back to her place and have sex; it was hers. Maybe she is feeling embarrassed, but that is no reason to accuse you of drugging and raping her. 

She says she does not remember anything apart from dancing with you, then waking up with you in her bed. You don’t even take drugs, let alone slip them into girls’ drinks; however, you’ve heard rumors that some guys on campus are into that. What if the reason she does not remember anything is that someone else spiked her drink

Is that your fault? Does that mean you could be found guilty of date rape because she was not in full control when she slept with you? She seemed a little out of it, but you assumed it a result of the alcohol she drank.
