3 things to do next when you’re accused of date rape

“Date rape,” or acquaintance rape, is a form of sexual violence against someone you know and may even have been romantically involved with at some point. It’s particularly problematic on college campuses. A lot of times, drugs and alcohol are involved and the actual details of what happened aren’t clear.
Make no mistake, however: There’s no easy way to explain your way out of the situation if you’ve been accused of date rape or the sexual assault of an acquaintance. Because colleges have a vested interest in maintaining a reputation for safety, they often have rules in place that make it difficult for someone falsely accused to defend themselves. Plus, you’ll more than likely face an investigation (and possible arrest) by the police.
If you’re facing allegations of date or acquaintance rape while in college, the following tips may help your situation:
- Understand that you are in serious trouble. This situation will not blow over. Even if the alleged victim has doubts about the encounter, it’s possible that they may be swept up in the “machine” of enforcement and become afraid of recanting.
- Keep your emotions and temper in check. One of the worst things you could do right now if hand the alleged victim, the school or the police new evidence against you. If you try to approach the alleged victim, talk to their friends about the situation or start posting on social media about what happened, that can all be used against you in a hearing.
- Listen to your defense attorney. You need an experienced attorney who can help you defend yourself both during the college investigation and the police investigation. However, even the best attorney can’t help you if you don’t listen to their advice from the beginning.
